RateMyPrompts terms of use

1. About us and these terms

RateMyPrompts (ratemyprompts.com) is a brand of theround ltd, a company registered in England and Wales, number 15402779, registered office 131 Finsbury Pavement, London EC2A 1NT, VAT number 459080279. "We" means theround ltd.

These terms apply when you use RateMyPrompts. You accept them by ticking the box when you submit a prompt set. Our privacy notice explains how we use personal data and our cookie policy explains cookies. Our consultancy brand, Zebora, has its own terms.

2. Who can use it

RateMyPrompts is for business use only. By submitting a set you confirm that you are 18 or over, acting for a business, using your work email address and authorised to accept these terms for that business. It is not offered to consumers.

If you submit a set on behalf of a client, for example as an agency or consultant, you confirm that the client has allowed you to do so

You must not use RateMyPrompts if you are located in a country, or are a person, subject to UK, EU, UN or US sanctions.

Nothing in these terms takes away rights you have under the law of your country that cannot be excluded by contract.

3. What the service is

You submit a list of prompts, the questions you use to track your brand in AI assistants, together with your email address. We grade the list against our rubric and give you a scorecard with recommendations. We email you a link to your scorecard and may also show it on screen.

In these terms, "your prompts" and "your set" mean everything you submit: the prompts themselves and any other information that comes with them, such as tags, categories, markets or other fields.

We may submit your prompts to third-party large language models (LLMs) to grade your set and for the analysis described in section 6. The providers of those models act as our service providers under section 7.

While RateMyPrompts is in beta, every prompt set is also reviewed by Zebora analysts.

The scorecard is an automated assessment of a list of questions. It is not advice. It does not measure how visible your brand actually is. We make no promise about what results you will get from AI assistants or from following any recommendation.

We may change, suspend or withdraw the service, or the rubric, at any time.

4. Keeping your prompts

We keep the prompts you submit and the scorecards we produce from them indefinitely. We do this so we can analyse prompt sets, build insight into how brands are tracked in AI assistants and improve our products.

Your email address is handled separately. Section 8 explains how to have it and any other personal details deleted. When we do that, we keep the prompts with your details removed, so they can no longer be traced back to you.

5. What you submit

You must have the right to submit the prompts you give us, including any information about other people or other companies inside them. Please do not include anyone's contact details. Do not include information that is confidential to someone else unless you are allowed to share it with us. You are responsible for what you submit.

You will compensate us for any claim, loss or cost, including reasonable legal fees, that arises because you broke these terms or submitted something you had no right to share.

6. Who owns what and how we use your prompts

Your prompts stay yours. When you submit a set you give us a worldwide, non-exclusive, royalty-free licence to:

store, copy, analyse and grade it, including by submitting it to large language models
show you the results
use it for analysis and insight, including statistics and anonymous benchmarks we may publish
use it to develop and improve our products, including training our own AI models

The licence lasts for as long as we keep the set, as section 4 explains.

Statistics and benchmarks we publish from prompt sets will not include your prompt text or identify you or your brand.

We may name the businesses and brands that use RateMyPrompts, including any brand a set is submitted for. We may also show their logos on our website, in presentations and in other marketing. If you submit a set for a client, you confirm that you may let us name that client. If you can't, tell us not to. To ask us not to name your business or a brand, email privacy@ratemyprompts.com and we will stop within 30 days.

The scorecard, the rubric and the method are ours. You may use and share your scorecard for your own business purposes, including with colleagues and clients. If you use the re-score feature, the revised set is yours on the same terms as the original.

7. Confidentiality

We treat your prompts as confidential. We will never sell your prompts or your email address. We will not share either with anyone except:

service providers acting on our instructions and bound to keep them confidential, including the providers of the large language models we submit prompts to, our hosting and cloud storage providers (including our databases and the tools that access them), our email and newsletter platforms and our customer relationship system
our staff and contractors, who are bound by confidentiality
our professional advisers, such as lawyers, accountants and insurers, who are bound by confidentiality
anyone who acquires all or part of our business, or a group company that takes over RateMyPrompts, who will be bound by these same commitments
where the law, a court or a regulator requires it

We never share your prompts or your email address with marketing, data or lead generation businesses.

We use your email address to send you your scorecard, to tell you about changes to these terms and to send you our newsletter. Our privacy notice explains this in full.

Newsletter. When you submit a set we add your email address to our newsletter. It covers prompts, GEO and related services from RateMyPrompts and Zebora, including webinars and events. Every issue has an unsubscribe link. Unsubscribing does not affect your scorecards.

Deleting your details. You can ask us to delete your email address and any other personal details at any time by emailing privacy@ratemyprompts.com from the address you used. We will do this within 30 days and confirm when it is done. We keep the prompts themselves with your details removed, as section 4 explains.

If you unsubscribe and later submit another set, we will add you to the newsletter again. You can unsubscribe again at any time.

9. Shareable links

Anyone with a scorecard link you share can see its headline score, but not your prompt text or the full report. You decide who you share a link with.

10. Fair use

Do not:

use automated tools to submit prompt sets in bulk or to get round the free limit or rate limits
use more than one email address, or other people's addresses, to get more free scorecards
try to access other people's scorecards or the systems behind the service
submit anything unlawful, or anything you have no right to share
copy the rubric or scorecards to build a competing product

The free allowance is 1 full scorecard per person, tracked by email address. We may change the allowance at any time. We may decline to grade any set, or limit or stop anyone's access, at any time and for any reason.

11. Zebora services

RateMyPrompts and Zebora are run by the same company. Scorecards may suggest Zebora's services. We may also pass your scorecard and email address to the Zebora team so they can follow up.

The Prompt Set Build and the managed programme are Zebora services. They are agreed on a call and governed by Zebora's terms and a written proposal agreed before work starts. Prices are set out in the proposal.

12. Paid features

RateMyPrompts is free during the beta. We may introduce paid features in future. If we do, we will show the price, the payment provider and any terms that apply before you buy. We will also update these terms.

13. Our responsibility to you

RateMyPrompts is provided "as is" and "as available". As far as the law allows, we exclude all warranties, conditions and terms not set out in these terms, including any implied terms about quality or fitness for a particular purpose.

Scorecards, recommendations and anything else we provide, including comments from Zebora analysts, are for information only. You are responsible for any business decisions you make based on them. We are not liable for any loss arising from those decisions or from acting on our recommendations.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

Otherwise, we are not responsible for loss of profit, revenue, business or opportunity, or for indirect or consequential loss. Our total liability to you under these terms is limited to £100. These limits apply whether a claim arises in contract, tort (including negligence), breach of statutory duty or otherwise.

14. Ending and changes

You can stop using RateMyPrompts at any time. We may stop providing it to anyone at any time. Sections 4 to 7, 13 and 15 continue to apply after you stop using RateMyPrompts.

We may update these terms at any time. We will show the new version and date here. We only need to tell you directly about changes that materially affect you: we will email the address you used before those take effect.

Each set is governed by the version of these terms you accepted when you submitted it, unless you later accept a newer version.

15. General

We may transfer our rights and obligations under these terms to a group company or to anyone who acquires all or part of our business. They will be bound by section 7.
These terms and our privacy notice are the whole agreement between you and us about RateMyPrompts. They replace any earlier promises, assurances or statements, including anything said on a call.
We are not responsible for delays or failures caused by events outside our reasonable control.
If any part of these terms is found unenforceable, only that part is treated as deleted. The rest still applies.
If we do not enforce a right straight away, we can still enforce it later.
Only you and we have rights under these terms.
If these terms are translated, the English version applies.
These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that we may seek an injunction or similar order in any country.
